Earlier, the court has on June 23 fixed July 03, for the respondents to open their case in defence of the petition by Labour Party Presidential Candidate, Mr Peter Obi and Alhaji Atiku Abubakar of People Democratic Party.

The parties, however, were challenging the outcome of the February 25 election that brought Ahmed Bola Tinubu as the president of Nigeria.

The electoral commission was to commence their defense against the petition filed by the Labour Party and its presidential election, Peter Obi on Monday July 03.

Meanwhile, during Monday’s proceedings, counsel for INEC, A.B Mahmoud, SAN, told the court that the commission had billed three witnesses to give their testimony to solidify their defence.

Mahmoud further told the court that the witness who was scheduled to testify was unavoidably absent from the court, and pleaded that the matter be Adjourned to the next day.

The PEPC headed by Justice Haruna Tsammani heeded the request following the agreement of other parties in the case.

The petitionees closed their case on June 23, leaving the stage for INEC and APC led Bola Tinubu in the matter to table their defence before the court.
